Standard Holiday Rental Terms and Conditions

Definitions:
"Booking" means the period for which you have paid to stay at the Studio. "Booking Amount" means the full charge for your stay (minus the refundable damage deposit). "Guests" means the person/s who stay overnight in the Studio during the Booking. "Management" means the Owners and Managers of the Studio which is Nth Coast Enterprises ABN: 47 824 687 502. "Visitor" means a person a Guest permits to visit the Studio during their Booking. "Studio" means Fig Tree Retro Studio located at 26 Spring Valley Road, Cudgera Creek, NSW 2484 and all its fixtures, fittings and equipment.    

 

1. Acceptance and Responsibility:

  • Payment of the full Booking Amount is required to confirm and secure a Booking and constitutes the Guests acceptance of these Terms and Conditions.

  • The Guest agrees that regardless of length of stay there is no tenancy or other rights created under any Landlord or Tenant laws and there are no such laws that apply to the Guest’s stay.

 

2. Booking Amount:

  • Payment of the full Booking Amount is required at the time of reservation. Once paid in full, the Booking is confirmed. In some cases, and by prior agreement by Management, Guest can provide 50% deposit if their stay is more than 4 weeks away.

  • Payment must be in Australian Dollars net of any bank or other transaction charges and made by the following methods: PayPal, Visa, MasterCard, Bank Cheque or by Online Bank Transfer.

  • Credit card payments can be made via the Fig Tree Retro Studio booking engine. Credit card payments are required in full (unless otherwise agreed with Management).

 

 3. Balance of Booking Amount:

  • Balance of the Booking Amount (including the refundable damage deposit) must be received by Management within 14 days prior to check-in. If not received by day 10, Management will contact Guest by telephone or email as a reminder that payment is due. If balance of the Booking Amount is not received by day 7, Management has the right to cancel the Booking and attempt to re-book the Studio. If successful, 100% of the deposit of the Booking Amount will be refunded less our $100 cancellation fee. If unsuccessful, 50% of the deposit will be forfeited.

 

4. COVID-Related Cancellations: 

In the event a guest has to cancel their booking due to COVID-19 lockdown or restrictions imposed by the Federal Government or States, the following COVID-19 cancellation policy will apply:

 

Bookings through our website (www.figtreeretrostudio.com.au) or phone booking:

  • No refund will be given; however, bookings will be eligible for a credit in the form of a date change, free of charge.

 

Bookings through third-party platforms (Expedia, Airbnb, VRBO, etc.):

  • The nominated cancellation policy on the Fig Tree Retro Studio listing applies.

 

5. Standard Cancellation or Variation:

 

Cancellation by Guests:

  • Cancellation of 8 days or more of arrival:

 

  • Date change (depending on availability)

OR

  • Management will endeavour to fill that booking with another reservation. Duration time in which the reservation calendar will be re-opened to the public will be 5 days from the date cancellation is received, if possible. If Management is successful, the deposit or full payment will be refunded, less our $100 cancellation fee. If Management is unsuccessful, 50% of the total cost of accommodation or deposit will be forfeited.

  

  • Cancellation of 7 days or less of arrival: 

    • 100% of total cost of accommodation or deposit will be forfeited.

 

No refunds for no shows or early checkouts.

Cancellation by Management:

 

  • In the event of natural disasters such as flood, brushfire, blizzard, cyclone, hurricane, earthquake, landslide, lightning, war, terrorist attacks or nuclear accidents where the Studio has been destroyed, access roads have been closed, or access to the area is unsafe and makes the Studio temporarily inhabitable resulting in a frustrated contract on the part of Management, Management will refund all monies paid by the Guest or by agreement with Guest, Management will move the reservation until a later date, if possible.

 

  • Management reserves the right to cancel reservation if pet limitation protocol is breached (i.e. if Guests, upon arrival, bring more than 1 pet to stay, without the express written consent of Management). No refund will be paid back to Guest.

 

  • Maximum 2 people occupancy in the Studio. Management reserves the right to cancel reservation if guest limitation protocol is breached (i.e. if more than 2 Guests occupy the studio per reservation, without the express written consent of Management). No refund will be paid back to Guest.

 

  • Visitor means a person a Guest permits to visit them at the Studio during their Booking. Visitors are limited to 2 people, and limited to stay with Guest a maximum of 4 hours per day. Management reserves the right to cancel reservation if visitor limitation protocol is breached (i.e. if there are more than 2 visitors, and they exceed the 4 hours per day limit, without the express written consent of Management). No refund will be paid back to Guest.

 

  • Bereavement or Hospitalisation:

    • Cancellation as a result of bereavement within the Guest’s family (mother, father, husband/wife, sister, brother, child) or hospitalisation of the Guest’s immediate family (husband/wife, child) between 7 days and 5 days before arrival, the Guest will be reimbursed the full price. No cancellation fees will be incurred. Less than 2 days before arriving, the Guest will receive 75% and Management 25% of the total cost of accommodation. No cancellation fees will be incurred. A death certificate or hospitalisation certificate is required as proof.

 

  • Date change is not applicable to Australian holiday periods (i.e., Christmas, New Years, Good Friday/Easter, Queens holiday, etc.), special occasions (i.e., Valentine’s Day) or Festival event dates (i.e., Splendour in the Grass; Falls Fest; or BluesFest).

  • Only one alternative date change will be honoured by Management.

  • If the nightly rate for the new date change is greater than the nightly rate of the original booking date, then the Guest­­ must pay the difference. If Guest refuses to pay the difference, the date change will be voided and Guest forgoes all rights to this option.

  • In some circumstances, the cancellation fee of $100 may need to be debited from the Guest’s credit card. Guests will be informed in writing of this.

  • Eligible refunds will be made through the Guests chosen payment method at time of reservation.

  • If a Guest requests a variation to the Booking, which reduces the number of nights stay, this will be treated as a cancellation (in respect of those nights) and therefore not refundable.

  • Minimum night's stay policy is 3 nights for the Studio (unless otherwise stated). No refund will be made for a variation to the extent that it breaches the minimum nights stay policy.

6. Refundable Damage Deposit:

  • A refundable damage deposit payment applies to all Bookings. Once the Studio has been inspected and deemed left in a similar state to check-in, it will be credited within 5 working days to the Guests designated payment method at the time of Booking.

  • Any damage, loss or expense incurred by Management during your Booking will be charged against the refundable damage deposit. Examples of this include but are not limited to any breakage, damage or excess cleaning requirements.

  • Your refundable damage deposit will be deducted by:

    • $100 as a replacement fee for any missing items including any of the vintage trinkets, retro decorations, books, retro related paraphernalia etc.

    • $75 fee for damage to property amenities such as trees or landscaping.

    • $30 if pet poo is left anywhere on the Studio grounds.

    • $15 as a replacement fee for broken dishes/glasses/bowls.

 

7. Pets:

  • Due to the limitations of the Studio, only 1 pet is allowed.

  • Whilst we understand that owners may need to duck out without their pets in tow at times, for the safety of your pet, and for the comfort of nearby neighbours, we ask that pets NOT be left unattended while holidaying with us, as from what we have observed, it causes undue stress on pets resulting in incessant barking.

  • A $30 pet fee applies.

 

 8. Amenities:

  • If the amenities that is offered at the Studio as described on our website, namely the WIFI, is not operating due to the fault of Telstra or other telecommunications operator, which then results in Guest terminating their reservation with us, no refund will be offered to Guest in this instance as this is due to circumstances or situations external to the Studio, and is outside of Management’s control. In good faith; however, Guest will be offered a credit of days remaining in their reservation to be used within 6 months and only on ‘like for like’ days.

  • The WIFI data at the Studio is not ‘unlimited’, therefore, guests are encouraged to use the WIFI reasonably. In the event the WIFI data is depleted due to overuse, Management will not be responsible for replenishing / adding additional data.

 

9. Visitors:

  • Visitor means a person a Guest permits to visit them at the Studio during their Booking. Visitors are limited to 2 people, and limited to stay with Guest a maximum of 4 hours per day. Breach of this will result in cancellation of Guest’s reservation as mentioned in Section 4 above.

 

10.  House Rules, Code of Conduct and your Responsibilities:

  • To maintain a good standard for our Guests and neighbours, we require certain terms and conditions to be complied with. We appreciate most Guests will respect the Studio and our neighbours, but the occasional abuse requires that we state the following conditions.

  • You must comply with all applicable House Rules, Code of Conduct and all instructions from Management concerning occupancy, health, safety and quiet enjoyment of the Studio and our neighbours. Breach of the House Rules is a breach of the Terms and Conditions of occupancy.

  • Whilst we understand that owners may need to duck out without their pets in tow at times, for the safety of your pet, and for the comfort of nearby neighbours, we ask that pets NOT be left unattended while holidaying with us, as from what we have observed, it causes undue stress on pets resulting in incessant barking.

  • Whenever you are absent from the Studio, please close all windows and doors to maintain security and prevent rain and water damage.

  • Guests are responsible for ensuring that Visitors comply with these Terms and Conditions.

  • You are responsible for damage, breakages, theft and loss of the Studio, and any part of it during your stay. You must notify Management of this immediately. Management may recover from you the repair or replacement cost (at their discretion).

  • Management takes no responsibility for the Guest's/Visitor’s personal property.

  • Only the Guests nominated and agreed in the Booking may stay in the Studio overnight. No additional guests are allowed in the Studio. No visitors are permitted to stay in the Studio overnight.

  • Parties and functions are strictly prohibited. All noise to cease between 10.00pm and 8.00am. Breach of this condition may result in immediate termination and eviction without refund and extra charges for security, cleaning, garbage removal, wear and tear, repairs etc.

  • Disturbance to our neighbours, including undue or excessive noise are prohibited and may result in immediate termination and eviction without refund and extra charges may be made for security and other expenses.

  • Smoking is not permitted inside the Studio.

  • All linen, pillows, blankets and towels are supplied by the Fig Tree Retro Studio, and must be left where supplied in the bedrooms and/or bathroom on departure. Stolen or damaged linen will be charged against your refundable damage deposit.

 

11. Departure:

  • Checkout time is 10.00am. Breach of this timeframe will result in loss of refundable damage deposit or extra charges.

  • Late checkout is by arrangement only and subject to availability.

  • The Studio should be left in a similar state to its condition on arrival.

  • Before departure, all food must be removed from fridges, all rubbish put in the appropriate rubbish bins provided, crockery and cutlery washed and packed away.

  • Failure to leave the Studio in a clean and tidy condition may incur extra cleaning charges, which will be deducted from the refundable damage deposit.

  • All furniture must be left in the position they were in when you arrived.

  • The Studio should be vacated on time and secured. All windows and doors are to be closed.

 

12.  Unavailability:

  • The owners will make every effort to ensure the Studio is available as booked. However, the owners reserve the right to make alterations to Bookings due to unforeseen circumstances.

  • If the Studio becomes unavailable for your occupancy due to unforeseen circumstances (eg. fire, storm, damage, etc) then Management will inform you immediately and any monies paid will be refunded in full.

 

13.  Problems or Complaints:

  • In the case of any problem or complaint, you must inform Management at the earliest opportunity so that Management has the chance to rectify the situation as quickly and efficiently as possible.

  • You must allow repair/service people access to the Studio during reasonable hours.

  • Any complaint, which cannot be resolved locally, must be notified in writing to Management prior to departure from the Studio.

  • Failure to follow this procedure may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have.

 

14. Variations to Terms and Conditions:

  • Variations to these Terms and Conditions may only be made by prior arrangements with Management in writing.
